As of September 1, 2005, State Law prohibits burning household refuse or rubbish in Montgomery County on less than 5 Acres of land or within 300 feet of a neighborhood or subdivision. Violating this State Law is a Class C Misdemeanor punishable by mandatory Community Service and a fine of up to $500. The above has been known to the residents of this subdivision since 2005 yet many continue to burn illegally. The Montgomery County Fire Marshals office said, "Burning anything man-made is against the law anywhere trash service is offered".
The noxious cancer-causing fumes from the illegal burns in this subdivision should not be allowed and the perpetrators of the illegal activity should be held to account. The disgusting smell of burning plastic, garbage, styrofoam, household refuse, tires, mattresses, and couches should not be tolerated by the Board of Directors, and will not be tolerated by this resident. A simple drive around the subdivision will show most of the culprits. A 55-gallon drum in the yard is a good signal, just like a couch on a burn pile.
